FACTS: An underinsured driver struck the side rear quarter panel of Plaintiff’s vehicle. PIP Insurance initially denied paying the claim, defining it as a minor impact collision. ERISA lien consisted of majority of the third-party settlement ($50,000). After filing a lawsuit against PIP, this lien was paid, in addition to $5,000 of attorney fees and $1,461.50 in wage loss. Third-party party settlement was $50,000 and UIM Settlement was $110,000.
